Probable Cause Can Still be
Determined as a Matter of Law
The Ninth Circuit recently reversed the denial of qualified immunity for a law enforcement officer for arresting a suspect for allegedly sexually molesting a 10-year old female student. The case, John v. City of El Monte was filed September 26, 2007. The case involved a fifth grade school teacher who intercepted notes written by a female student. The notes indicated that the teacher should die and was a pervert and lesbian bitch. The teacher showed the notes to the school principal who later requested a police investigation.
